What is Trade Mark ?
A Trade Mark popularly known as brand name, is a visual symbol in the form of a name, word, phrase, logo, symbol, design, image, or a combination of these elements applied to the commercial goods or service to enable the consumer public to identify one trader's goods from similar goods of other traders.
A Trade Mark must be capable of graphical representation and must be applied to goods or services for which it is registered.
In India, The Trade Marks Act, 1999 governs this and the law encourages registration of Trade Marks, as registration confers on the owner an exclusive right to use the mark.
